DermLens® Warranty Policy

1. Purpose of this Warranty
This Warranty Policy sets out the terms and conditions governing the manufacturer's warranty provided by DERMACODE Ltd ("DERMACODE", "DermLens", "we", "our" or "us") in respect of genuine DermLens® products purchased through the DermLens® Website or an authorised DermLens® distributor or reseller.
This Warranty Policy should be read together with the DermLens® Terms and Conditions of Sale, Website Terms of Use, Privacy Notice and any Instructions for Use supplied with the Product.
The warranty provided under this Policy is a voluntary manufacturer's warranty and is additional to, and does not affect, any statutory rights available to Consumers under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
This Warranty Policy applies only to genuine DermLens® products bearing a valid serial number and purchased from DERMACODE Ltd or an authorised DermLens® distributor or reseller. Products purchased through unauthorised sources, counterfeit products or products from which the serial number has been removed, altered or rendered illegible shall not be eligible for warranty cover.
Unless expressly stated otherwise in writing by DERMACODE Ltd, this Warranty Policy applies only to the original purchaser of the Product and is not transferable to any subsequent owner.
2. Standard Manufacturer's Warranty (12 Months)
Subject to the terms, conditions, exclusions and limitations contained within this Warranty Policy, DERMACODE Ltd warrants that each genuine DermLens® Product shall be free from defects in materials and workmanship under normal and intended use for a period of twelve (12) months commencing on the date of Delivery or, where applicable, the date of purchase.
During the applicable warranty period, DERMACODE Ltd shall, at its sole discretion and without charge for parts or labour, repair the Product, replace the Product with the same model or an equivalent model, or provide such other remedy as DERMACODE Ltd considers appropriate.
Any Product repaired or replaced under this Warranty Policy shall remain subject to the balance of the original warranty period and shall not give rise to a new warranty period unless otherwise required by applicable law.
This warranty applies only where the Product has been used in accordance with its intended purpose, the Instructions for Use and all applicable safety, operating and maintenance guidance published by DERMACODE Ltd.
The Customer shall retain reasonable proof of purchase, as such documentation may be required before any warranty claim is accepted.
3. Complimentary Extended Warranty (24 Months upon Registration within 28 Days)
DERMACODE Ltd offers purchasers of eligible DermLens® Products the opportunity to obtain a complimentary extension of the manufacturer's warranty from twelve (12) months to twenty-four (24) months.
To qualify for the complimentary extended warranty, the purchaser must:
- (a) purchase a genuine DermLens® Product from DERMACODE Ltd or an authorised DermLens® distributor or reseller;
- (b) register the Product through the official DermLens® Device Registration Portal within twenty-eight (28) calendar days of the original date of purchase;
- (c) provide complete, accurate and truthful registration information;
- (d) provide proof of purchase where reasonably requested by DERMACODE Ltd; and
- (e) comply with the requirements of this Warranty Policy, including accepting DermLens to contact you for marketing purposes in the future.
Registration submitted after the expiry of the twenty-eight (28) day registration period shall not qualify for the complimentary extended warranty unless DERMACODE Ltd expressly agrees otherwise in writing.
DERMACODE Ltd reserves the right to refuse, suspend or revoke an extended warranty where it reasonably believes that registration information is inaccurate, misleading or fraudulent, where the Product is counterfeit, stolen or obtained through an unauthorised source, or where the requirements of this Warranty Policy have not been satisfied.
The complimentary extended warranty provides the same scope of cover, limitations and exclusions as the standard manufacturer's warranty unless expressly stated otherwise within this Warranty Policy.
4. Warranty Coverage
Subject always to the exclusions contained within this Warranty Policy, the manufacturer's warranty covers defects arising from faulty materials or workmanship occurring during normal and intended use of the Product.
Where DERMACODE Ltd accepts that a defect is covered by this Warranty Policy, we shall, at our sole discretion, repair the Product, replace the Product with the same or an equivalent model, replace the defective component, or provide such alternative remedy as DERMACODE Ltd reasonably considers appropriate.
Warranty cover extends only to defects which materially affect the intended operation or functionality of the Product and which have not arisen through misuse, accidental damage or any other excluded circumstance.
Reasonable replacement parts, refurbished components or equivalent replacement Products may be used where appropriate, provided that the repaired or replacement Product performs substantially the same intended function as the original Product.
Where a Product is replaced under warranty, the original Product shall become the property of DERMACODE Ltd unless otherwise agreed in writing.
This Warranty Policy covers only the DermLens® Product supplied by DERMACODE Ltd. It does not extend to smartphones, mobile devices, protective cases, third-party accessories, software, applications or any other equipment manufactured by third parties, even where such equipment is used in conjunction with the Product.
5. Warranty Exclusions
This Warranty Policy does not apply to defects, failures or damage arising wholly or partly from:
- (a) accidental damage, impact, dropping, crushing or misuse;
- (b) improper handling, storage, transportation or maintenance;
- (c) failure to use the Product in accordance with its Instructions for Use or intended purpose;
- (d) unauthorised modification, repair, disassembly or attempted repair by any person other than DERMACODE Ltd or an authorised service provider;
- (e) use of incompatible accessories, attachments or equipment not approved by DERMACODE Ltd;
- (f) cosmetic deterioration, including scratches, dents, paint wear, surface marks or normal wear and tear that do not materially affect the operation of the Product;
- (g) water damage, liquid ingress, chemical exposure, corrosion or contamination unless resulting directly from a manufacturing defect;
- (h) damage caused by fire, flood, lightning, power surges, natural disasters or other external events beyond the reasonable control of DERMACODE Ltd;
- (i) deliberate damage, neglect, abuse, improper cleaning or improper storage;
- (j) removal, alteration, defacement or illegibility of the Product serial number or other identifying markings;
- (k) Products purchased from unauthorised sellers or distributors;
- (l) counterfeit Products or Products which DERMACODE Ltd reasonably believes are not genuine DermLens® products;
- (m) defects disclosed to the Customer prior to purchase or Products sold expressly as ex-display, refurbished or otherwise supplied with modified warranty terms; or
- (n) any circumstance which, in the reasonable opinion of DERMACODE Ltd, falls outside defects in materials or workmanship covered by this Warranty Policy.
This Warranty Policy does not cover routine servicing, preventative maintenance, cleaning, calibration, consumable items, accessories subject to normal wear, software updates or any loss arising from interruption to business, loss of profits, loss of clinical income, loss of data, loss of opportunity or any indirect or consequential loss.
Nothing contained within this Warranty Policy shall exclude or restrict any statutory rights available to Consumers under applicable law.
The application of optional personalisation or laser engraving performed by or on behalf of DERMACODE Ltd shall not invalidate or otherwise affect the Customer's entitlement to the standard manufacturer's warranty, the complimentary extended warranty or DermLens Protect+. Any warranty claim shall be assessed in accordance with this Warranty Policy as though the Product had not been personalised, provided that the defect has not arisen as a consequence of the personalisation itself, any subsequent unauthorised modification or any other circumstance excluded under this Warranty Policy.
6. Warranty Claims Procedure
A Customer wishing to make a claim under this Warranty Policy shall notify DERMACODE Ltd as soon as reasonably practicable after discovering the alleged defect.
Warranty claims should be submitted by contacting DERMACODE Ltd using the contact details published on the DermLens® Website and should include sufficient information to enable the Product and the alleged defect to be identified.
DERMACODE Ltd may require the Customer to provide reasonable supporting information, including:
- (a) proof of purchase;
- (b) the Product serial number;
- (c) photographs or videos illustrating the alleged defect;
- (d) a description of the circumstances in which the defect occurred; and
- (e) such additional information as DERMACODE Ltd may reasonably require to assess the warranty claim.
Where reasonably necessary, DERMACODE Ltd may require the Product to be returned for inspection, testing or repair. Unless otherwise agreed, the Customer shall follow the return instructions provided by DERMACODE Ltd and shall ensure that the Product is appropriately packaged to minimise the risk of damage during transit.
Failure to provide reasonable information or to comply with the warranty claims procedure may delay the assessment of the claim.
Submission of a warranty claim does not constitute acceptance by DERMACODE Ltd that the Product is defective or that the claim falls within the scope of this Warranty Policy.
7. Repair or Replacement
Where DERMACODE Ltd determines that a warranty claim is valid, we shall, at our sole discretion, repair the Product, replace the Product with the same model or an equivalent model, replace the defective component or provide such other remedy as DERMACODE Ltd reasonably considers appropriate.
Repairs may be carried out using new, refurbished or equivalent replacement components which meet the functional and quality standards required by DERMACODE Ltd.
Where a replacement Product is supplied, it may consist of a new Product or a refurbished Product of equivalent specification and performance.
Any Product or component replaced under this Warranty Policy shall become the property of DERMACODE Ltd unless otherwise agreed in writing.
DERMACODE Ltd shall use reasonable endeavours to complete warranty repairs or replacements within a reasonable period. However, no specific repair or replacement timescale is guaranteed, and delays arising from the availability of components, transportation, customs requirements, manufacturing lead times or other circumstances beyond our reasonable control shall not constitute a breach of this Warranty Policy.
Repair or replacement under this Warranty Policy shall constitute the Customer's sole remedy in respect of a valid warranty claim, subject always to any statutory rights which cannot lawfully be excluded.
8. Limitations
This Warranty Policy constitutes a voluntary manufacturer's warranty provided by DERMACODE Ltd and is additional to any statutory rights available under applicable consumer protection legislation.
Except as expressly provided within this Warranty Policy or required by law, DERMACODE Ltd makes no representation or warranty, whether express or implied, regarding the Products, including any implied warranty of merchantability, satisfactory quality or fitness for a particular purpose.
DERMACODE Ltd shall not be liable under this Warranty Policy for any indirect, incidental, consequential or economic loss arising from a defective Product, including, without limitation, loss of income, loss of profits, loss of business, loss of clinical revenue, loss of opportunity, loss of goodwill, loss of data or interruption to professional practice.
Nothing contained within this Warranty Policy shall be interpreted as guaranteeing uninterrupted operation of the Product or that the Product will be entirely free from minor defects which do not materially affect its intended functionality.
The remedies expressly provided within this Warranty Policy shall constitute the sole contractual remedies available under the manufacturer's warranty, without prejudice to any statutory rights available to Consumers.
9. DermLens Protect+
DERMACODE Ltd offers purchasers of eligible DermLens® Products the opportunity to purchase DermLens Protect+, an optional enhanced protection programme designed to provide extended product protection together with exclusive member benefits.
DermLens Protect+ is separate from the complimentary twenty-four (24) month extended warranty available upon eligible product registration and is subject to this Warranty Policy together with any additional terms published by DERMACODE Ltd at the time of purchase.
Subject to eligibility and payment of the applicable fee, DermLens Protect+ currently provides:
- (a) an extension of the manufacturer's warranty, providing a total warranty period of five (5) years from the original date of purchase; and
- (b) ten (10) complimentary MoleScan® lesion assessments provided as part of the collaboration between DermLens® and MoleScan®, having a current recommended retail value of up to £1,500.
The complimentary MoleScan® assessments are provided exclusively as a promotional membership benefit of DermLens Protect+ and do not form part of the manufacturer's warranty.
Redemption and use of the complimentary MoleScan® assessments shall be subject to the MoleScan® Terms of Use, Privacy Notice and any other applicable terms and conditions in force at the time the assessments are redeemed.
Unless otherwise expressly agreed in writing by DERMACODE Ltd, the benefits available under DermLens Protect+:
- (a) are available only to the original purchaser of the eligible DermLens® Product;
- (b) are non-transferable;
- (c) have no cash value;
- (d) may not be exchanged for alternative products, services or discounts;
- (e) may not be resold or assigned; and
- (f) shall expire in accordance with the applicable DermLens Protect+ membership terms.
DERMACODE Ltd may introduce additional benefits, amend existing benefits or discontinue benefits offered under DermLens Protect+ from time to time. Such amendments shall apply only to future purchases of DermLens Protect+ unless otherwise required by law or expressly agreed by DERMACODE Ltd.
Nothing contained within this section shall affect the scope of the standard manufacturer's warranty or the complimentary extended warranty described elsewhere within this Warranty Policy.
10. General Provisions
This Warranty Policy shall be governed by and construed in accordance with the laws of England and Wales.
Nothing contained within this Warranty Policy shall exclude, restrict or limit any statutory rights available to Consumers under applicable law.
If any provision of this Warranty Policy is determined by a court or other competent authority to be unlawful, invalid or unenforceable, that provision shall, to the extent necessary, be deemed severed without affecting the validity or enforceability of the remaining provisions.
DERMACODE Ltd reserves the right to amend or replace this Warranty Policy from time to time in order to reflect changes in legislation, regulatory requirements, manufacturing processes, product development or business operations. Any revised version shall apply to Products purchased after the effective date of the revised Warranty Policy unless otherwise required by law.
This Warranty Policy shall be read together with the DermLens® Terms and Conditions of Sale, Website Terms of Use, Privacy Notice, Cookie Policy, Returns and Refund Policy and Shipping and Delivery Policy.
